By accessing, browsing, or interacting with www.colombohomes.lk (the “Platform”), requesting property information, or initiating communications through our website forms, telephone lines, or official WhatsApp channels, you confirm that you are at least 18 years of age, legally capable of entering into binding contracts, and unconditionally agree to comply with and be bound by these Terms.
If you do not agree with any provision of these Terms, you must immediately discontinue use of the Platform.
2. Description of the Platform
ColomboHomes operates an online real estate discovery, portfolio showcase, and property enquiry coordination platform. We assist prospective buyers, investors, tenants, property developers, and owners in discovering residential condominiums, luxury houses, villas, and commercial real estate across Colombo and the Western Province of Sri Lanka.
ColomboHomes provides an information portal and brokerage coordination service. ColomboHomes is not a banking institution, depository, escrow provider, or licensed credit facility. We do not hold customer funds in escrow, nor do we directly execute deed registrations on this website.
3. User Accounts & Portal Access
Access to administrative and agent management portals is restricted strictly to authorized ColomboHomes personnel and approved consultant partners. Authorized users must maintain the absolute confidentiality of their authentication credentials and are responsible for all actions occurring under their accounts.
Any unauthorized attempt to breach, bypass, brute-force, or access protected management interfaces is strictly prohibited and constitutes a violation of these Terms and applicable cybercrime laws of Sri Lanka.
4. Property Listings & Representation
Property owners, developers, and consultants who submit listings for publication represent and warrant that:
- They are the rightful legal titleholders or possess written authorization and mandate from the lawful owners to market the property.
- All pricing details, land extents (perches/sq.ft), condominium floor areas, deed classifications, and encumbrance information submitted are true and verifiable.
- Photographs and architectural renderings provided do not infringe any third-party intellectual property or copyright.
5. Accuracy of Listing Information & Purchaser Due Diligence
While ColomboHomes undertakes reasonable efforts to verify property data provided by developers and owners, all property details, dimensions, building floor plans, deed categories, tax assessments, and prices listed on the Platform are presented for informational and guidance purposes only.
Prospective purchasers and lessees are strongly advised to engage an independent Attorney-at-Law and Notary Public to conduct formal title searches, inspect original deeds and local authority street line certificates, and confirm planning approvals before executing any binding agreement or paying deposit sums.
6. User Conduct & Prohibited Activities
When utilizing the Platform, you agree not to engage in any of the following prohibited behaviors:
- Submitting fictitious, misleading, fraudulent, or harassing inquiries or viewing appointments.
- Using automated web scrapers, crawlers, robots, or extraction scripts to harvest property listings, images, or contact numbers without prior written authorization.
- Impersonating ColomboHomes staff, consultants, or real estate brokers.
- Introducing malicious software, viruses, corrupted files, or disruptive code to the Platform.
- Attempting to reverse-engineer, decompile, or tamper with the underlying codebase or infrastructure.
- Engaging in any conduct that violates applicable Sri Lankan municipal, commercial, or criminal legislation.
7. Enquiries, Phone & WhatsApp Communications
By submitting an enquiry form, telephone call, or WhatsApp message to our published contact channels, you consent to receive direct telephone, electronic mail, or WhatsApp messages from ColomboHomes and our assigned consultants solely regarding your property interests.
You may opt out of further communication at any stage by notifying the consultant or emailing info@colombohomes.lk.
8. Payments, Conveyancing & Transactions
ColomboHomes does not collect or process property purchase funds, down-payments, or mortgage disbursements through this web application. All monetary transactions, title transfers, and contract executions in connection with Sri Lankan property must be conducted through licensed commercial banks, reputable escrow conduits, and formal deeds attested by duly appointed Notaries Public in Sri Lanka.
9. Intellectual Property Rights
The ColomboHomes name, logos, website layout, graphics, button styles, digital imagery, software code, and compilations are protected by intellectual property, trademark, and copyright laws. You may not reproduce, adapt, distribute, display, or exploit any component of our branding or listings for commercial purposes without our express written permission.
10. Availability & Modifications
We endeavor to maintain high website availability; however, we do not guarantee uninterrupted, error-free, or continuously secure access to the Platform. We reserve the right to suspend, withdraw, or update properties, features, or website sections without notice for maintenance, server upgrades, or operational reasons.
11. Disclaimers & Limitation of Liability
THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF SRI LANKA, COLOMBOHOMES, ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, punitive, or consequential losses arising out of your access to or inability to use the Platform.
- Any inaccuracies, typographical errors, price changes, or prior sales of listed properties.
- Any contractual disputes or financial losses between property buyers, sellers, landlords, and tenants.
12. Indemnification
You agree to defend, indemnify, and hold harmless ColomboHomes, its management, consultants, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Platform.
13. Governing Law & Jurisdiction
These Terms of Service and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the substantive laws of the Democratic Socialist Republic of Sri Lanka.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts of law in Colombo, Sri Lanka.
14. Changes to the Terms
We reserve the right to revise or update these Terms at our sole discretion. Any changes will become effective immediately upon being posted on this page with an updated “Last Updated” date.
